Judge Reinstates Off-Roader Ban in Dunes Area

A federal judge in San Francisco has temporarily reinstated a ban on off-road vehicles on a vast expanse of sand dunes in Imperial County that has been the site of a long-running dispute between conservationists and champions of motorized recreation.
The steep, sandy slopes of the Algodones Dunes are a magnet for thousands of dirt bike and all-terrain vehicle enthusiasts but are also home to about 160 rare plants and animals.
The U.S. District Court decision, handed down Tuesday, ensures that nearly half the dunes, about 50,000 acres, will remain off limits to off-road machines pending further action in the case.
"Nothing changes on the ground. It's a stay against any change in use at the dunes. To us, this is a victory. This is a very good step in the right direction," said Julie Teel, attorney for the Center for Biological Diversity, one of four environmental groups involved in the case.
The groups filed a lawsuit in May challenging the Bush administration over a biological study that is part of a proposed management plan for the dunes. The suit argues that the study, prepared by the U.S. Fish and Wildlife Service, was flawed and formed the basis for a decision by the Bureau of Land Management to open most of the dunes for off-road vehicle use.
Plaintiffs in the suit, including the Center for Biological Diversity, the Sierra Club, Public Employees for Environmental Responsibility and Desert Survivors, said widespread use of off-road vehicles at the dunes would harm a variety of plants and animals, in particular the Peirson's milk vetch, a rare plant protected under the Endangered Species Act.
Conservation groups sought a preliminary injunction to prevent lifting of the off-road vehicle ban, which had been ordered by the Clinton administration. The federal agencies argued that one was not needed because they were prepared to review the biological study. But U.S. District Court Judge Susan Illston ruled that the land must remain closed to vehicle use until the court has an opportunity to examine the biological study.
Conservationists and off-road enthusiasts have tussled for control of the 40-mile-long dune area for decades. The dunes draw more than 3 million visitors a year. On busy holiday weekends, as many as 250,000 off-road riders gather there.
Two years ago, three people were killed and dozens injured, including a park ranger who was run over, during Thanksgiving weekend.
In January the California Off-Highway Motor Vehicle Recreation Commission refused to continue state funding for administration of the recreation area, charging that the BLM had poorly managed the area.

How much time do they need to "examine" the study? Its just another tatic to buy time - But we are wiser to the ways of the GREEN people. Its ok for the Greenies to claim a one-sided flawed study and these Hypocrytes listen but when the off-road cummunity calls a foul its takes an act of GOD to get heard.
Our day is coming and your greenies who destroy more then you save are losing ground.
BTW - The Times is no longer even a valid source of news anymore. They have proven that.

Loki, you should try not to take the Troll bait.
This "guy" is what is known as an Internet Troll. If you look it up, you'll find pages and pages of information about his curious hobby of visiting message boards that he knows nothing about, only to be as disruptive as possible. This particular Troll has tried everything to cause as much trouble between the good people who use this BBS as possible, and it is only because the owners of this message board are so terribly forgiving that he is allowed to continue to post here. He has been thrown off of so many others that I've lost count.
He brings absolutely nothing of value to any thread or post.
He consistently misquotes, misrepresents and outright lies to the readers of these forums.
He does this because he likes the reaction he gets, not because he even believes the stuff he prints.
Oh, and for aren't we lucky... this particular Troll has a genuine beef against OHVs. Mind you he doesn't care about or do anything for conservation, although he'll try like heck to convince you of he does... but he does have a genuine beef against off roaders.
Seems he doesn't want to fence his land, which happens to snuggle up against BLM managed land, but he doesn't like it when the OHVs accidentally wander onto his property. He whines and complains that the BLM should pay for it (it's always someone else's fault... you know the type) instead of taking care of his own business. He's got some twisted idea that they are persecuting him and he's black inside because of it.
He's built up a hatred for everything that is related to off roading and he brings his hatred here to cause as much disruption as possible.
And he's allowed to because the people who own this message board are kind and forgiving and there's probably a little pity thrown in there too.
But it is a waste of time to reason with or try to debate this or any other Internet Troll. He wins when you try.

You know what you are and I know what you are and most of the people know what you are. Some don't, but they learn quickly.
I will not apologize for being less tolerant of an Internet Troll than others have been. You have a definite pattern of nonsense that is easy to follow and when you reach a certain point in your pattern, you are heavily moderated. That's the way it is and that's the way it will stay. If you don't like it, well, too bad. Buy a hankie.
