In Parker the "resorts" are "managed" by the BLM, they specified no OHV activity at all within the "managed" lands. We have to tow out and in now...sucks...but people keep voting these idiots in....so it is what it is...

Where's Mr. Hamada's question and answer board...he should know where th limited use area starts...

I sent an email from the BLM website this morning, still waiting for an answer....

Robbie, thanks for being so involved. This ticket isn't about the money but the principles...
1. New laws but posted nothing
2. "BOARDMANVILLE" for both owner and duners
3. To help my fellow duners "not" get a ticket and possibly fight this

Everyone have a fun-tastic day smile.gif

What is "SIGNED OPEN"?

"Signed open" means their has to be a sign stating open trail. Same trouble at Dove Springs
A trail with a sign "trail closed" and a trail with NO sign are the same off limits

A similar situation in Oregon forests.

The old system was you could use any road or trail unless it was gated or had signs saying it was closed. Just this year the Forestry Department came out saying " we don't have the resources to manage that large area effectively" So they instituted a new system. All roads and trails are closed unless specifically posted with signs saying open to use.
The ironic thing is that for many years the offroaders, motorcyclist, horse riders, hunters and hikers we all in fighting between each other for use of this and that. Now all of the area is off limits to everyone.

And from what I have heard there is not much chance of a turn around.

Grrr, that makes me so mad!!! First of all, they pay these environmentalists "big bucks" to protect the "beatle." Then, they have always posted signs in the furtherest areas of Glamis when the area is closed. These guys surely didn't take a pay cut therefore, make them work....POST THE PROPER SIGNS!!!

My guess based on what we know so far...

You stated the LEO told you he was gonna give you a smaller fined ticket vs. the one for driving on Ted Kipf road.
So you got a ticket for driving an OHV on an unmarked trail. Well, that is not a legit ticket. You should fight it.

You were in ISDRA area. That area is Limited use, but there are no signs to designate "Open" trails. (Yet..I bet they post some soon)
Tell the judge you were on an existing OHV trail within the ISDRA area.

The Law you broke was driving down Ted Kipf Rd.....But thats not the ticket they gave you.

Fight the ticket, I really feel you'd win.

So what did we learn today?

Only Cross Roads at a 90 degree angle in a safe manner in your OHV.
Only cross the Rail Road tracks at the designated cement Crossing along HWY 78.
Only use Existing (Until marked as Open) OHV Trails in the ISDRA area East of the RR Tracks.

I did learn something....first off, I learned that I broke NO laws. LOL, I never went onto Ted Kipt Rd....I was parallel to Kipt Rd on trails. Even when officer told me to pull down the little hill that runs side of, I said NOOOOO...and I sat there and he had to walk to me. I will fight the ticket for sure and post here when I get done but...in the meantime, beware of these kinds of false tickets, and watch for them guys with badges....they have entirely too much power over our dunes.

You made me laugh, thanks for that...I needed a laugh, been tuff times lately. smile.gif

That is nothing, I have a Arctic Cat that has a street legal plate in AZ and the ranger at the SSS said I could get a ticket in Ca because I have nobbie tires and they are not legal on roads in CA. He solved my problem now I will ride in AZ, UT, & CO and stay away from CA. Except Glamis which I will stay in the dunes. CA has some crazy laws. A lot of times you can't camp close to the trail heads and I only wanted to drive from my camp to the trail heads. In Utah they have tons of trails and they treat you great. There are a lot of good trails in AZ and they treat you good also. That is my two cents. Stay out of CA to trail ride, and drive your truck to Boardmanville.

Great idea guys....I have a few bucks to chip in on that one tongue.gif

Does this mean that Boardmanville will be closed? A friend of mine told me about this last night and I was shocked. I wonder how Jeanie is doing now that this is happening?

I went out the weekend before Halloween and we jumped the tracks and had no problem. It sounds like those days are over.

Why would they want to close the crossing @ wash 10? Sounds to me like they are trying to put a squeeze on the bar???
dune78
boardmanville is not closed...it is still open and serving cold beer.....pack up the trucks get a sober driver and have some cold ones....jean can really use the support of the off road people right now...i will be packing my truck and going over there just to proove a point....you can't stop me from getting there...its very bad that they have forced people who go there to use ted kipf instead of boardmanville underpass....i have a letter from railroad written to chuck boardman in 1990 that gave him permission to dig a depth of 6 feet so that people could use the underpass instead of going over tracks witch he felt was less danger......IT IS SIGNED BY A CHIEF ENGINER...me and my freinds have been digging it out for years for chuck and then jean.....not sure where i can go with it but i wish we could do something....we have never had a problem till now....i think they should make the underpass a designated trail so offroaders and property owners on the east side of the tracks would have a safer way to get to baordmanville and tthe dunes...HELP OUR LANDMARS LIKE BOARDMANVILLE AND GO AND HAVE COLD ONE ....
xXQuickSandXx
Right on dune78!! I won't be quading over there anymore but will drive the truck as well. It's part of our Glamis ritual beer.gif

I was out there for Halloween weekend. Sat at Old's with my group/family and decided to take a ride to Boardmanville...some would ride the dunes and some would ride to camp, drop off chairs and grab money for beer. I was driving our 2008 Ranger, went over railroad tracks and began heading down Kipton Road when I saw a Ranger sitting there on road....I quickly turned around and went up on the side where tracks are made with quads and such. As I headed towards the Ranger, he turned on his lights and when I got close he yelled at me to stop and come down on road. I thought NOOOOO, I am NOT going to get on that road for a ticket so I sat up top. He came to me and asked for my drivers license and registration. I didn't have my license on me but gave him all the info. He wrote me a ticket.....he said he gave me a break cause that fine is normally $1500.00 for California but he wrote it as federal so it would not be points on my license and ONLY cost me $125.00. Wow...that guy was a jerk!!! Can only get to Boardmanville by vehicle on road, any other way will get you a ticket.

BEWARE!!!!

yep right don't belive what he said i was told the same thing I pay my ticket and now is on my driving record go to court and fight it good luck

What about the letter that dune78 says the chief engineer signed? Is there any recourse with this?

Can you PHYSICALLY get to where the opening for Wash 10 was, or is it fenced off by the RR? Even if we dug out the wash, IF it was OK with the RR... the wash is not a "designated trail" within the ISDRA... you'd still get busted for going "cross country".

I am fighting this one, I will let you all know. But now this.....Did you know it it illegal to drive any UTV off-road in Glamis without a seatbelt? My ex got a ticket while driving to the trash bins at the washes....had his hand behind his back because his back was hurting, Ranger pulled him over, asked if he was drinking which he wasn't and NEVER drinks and drives (we think the Ranger thought he was hiding a beer behind his back) but since he wasn't had to cite him for something. Ranger told him that everyone "must" wear a seatbelt as required by law. Does anyone know if this is true?

I am replying to this myself, lol. I found the law on Seatbelts required in Glamis:

Are seat belts required to be used on all the seats, front and rear on UTV's, Golf Carts, and Sandcars to be legal when riding off road in Calif. or Ariz.?
Seatbelts are required to properly fastened in the front seats when originally equipped by the manufacturer. Seatbelts in the rear are not specifically required; however, if the passengers are not wearing seatbelts, the officer has the discretion to cite the driver for a violation of CVC 38330.
CVC 38330. It is unlawful to operate any vehicle or combination of vehicles which is in an unsafe condition, which is not equipped as required by this chapter or the equipment regulations of the governmental agency having jurisdiction over public lands, or which is not safely loaded.
43 CFR 8365.1-3(b) (1) The operator of a motor vehicle is prohibited from operating a motor vehicle in motion, unless the operator and each front seat passenger is restrained by a properly fastened safety belt that conforms to applicable United States Department of Transportation standards, except that children, as defined by State law, shall be restrained as provided by State law.
