Federal judge overturns gay marriage ban in Calif.

SAN FRANCISCO – A person close to the case says a federal judge has overturned California's same-sex marriage ban in a landmark case that could eventually land before the U.S. Supreme Court.

Chief U.S. District Judge Vaughn Walker made his ruling Wednesday in a lawsuit filed by two gay couples who claimed the voter-approved ban violated their civil rights.

A copy of the ruling had not yet been publicly released.

Both sides previously said an appeal was certain if Walker did not rule in their favor. The case would go first to the 9th U.S. Circuit Court of Appeals then the Supreme Court if the high court justices agree to review it.

Judge Walker was originally nominated for the bench in 1987 under Ronald Regan. He wasn't confirmed. Bush I re-nominated him and he was confirmed unanimously. Just sayin.

P.S. Ted Olsen, former Solicitor General under Bush II argued the case for the pro gay side. What is his special interest?

Murder and Rape are FELONIES.....big friggin difference..I for one think that the voting majority got screwed by a biased federal judge and a group of liberal idiots. HMMMM....maybe if we cry, bitch and moan that our rights were violated we could get "The individual that some call president" un-elected. After all...we didn't get our way so we should be able to file a lawsuit and have his voter majority elected term ended....

Okay, so lets change it up.

Lets say the idiots here in California vote for a law that allows peace officers to search anybody and everybody. The law is passed under the guise of public safety to ensure that the general population isn't carrying a weapon.

This is a clear violation of our 4th Amendment rights, and I firmly believe that there are enough voters to pass it in this state.

How would you feel when the new law makes it to the bench, and is immediately overturned as unconstitutional? Would you be pissed that people voted for something and it got overturned?

Simply because something is voted in doesn't make it legal or constitutional. That is where our Judicial branch comes into play.

There are probably a lot of parallels to todays ruling and the feelings that many had when anti-miscegenation laws were declared unconstitutional by SCOTUS. (Loving v. Virginia 1967)

I agree, gay marrige doesn't affect me. I'll have to explain it to my kids just like why some people are darker then others, fatter then others, celebrate Chanukah, celebrate Christmas, loose thier hair, and everything else.

A lot of people are swayed by their church.

A lot of people who spend a bunch of time in church also spend a lot of time talking to others in the same religious denomination.

There is rarely a dissenting opinion among these people when the church that they listen to has taken a stance.

With no dissenting opinion to go around, there is no conversational stimulation to push further thought on the subject.

This is exactly how the system is supposed to work. We are a constitutional federal republic. In that constitution are rights that are guaranteed. Those rights apply to all of us. Nowhere does the majority have the right to oppress a group - think about civil rights of the 60s, women's suffrage, Jim Crow laws. All were supported by the majority but not constitutional for the individual.

This is exactly how the system is supposed to work and you should be glad that it works this way. It is the system of checks and balances that were envisioned by the forefathers of this country.

His recent appointment of socialist Dr. Donald Berwick to oversee "Obamacare" while the Senate was on recess, because he knew the Senate would never approve, is simply disgusting. But yes, you are correct. He played the game like many others before him. It's just disturbing that the system of checks and balances has swayed so much. Our system of checks and balances is designed to protect us all from one branch holding too much power and when that balance is shifted, we all are at risk.

Why even vote anymore, it doent matter, the opposing parties fight and spend millions to overturn it and then in turn they fight back. There was a vote and the people spoke and now its showing you wasted your time voting.
