Probably by having the Insurance Commissioner tell the Insurance Companies to deny homeowner fire claims if they're not installed.

I have smoke detectors for fires, but a carbon monoxide detector for my home, please. If I want to kill my self buy breathing in carbon monoxide from my car in the garage, the last thing I want to hear is a alarm.

IMO i think its a good idea to have one but should not be forced to have a detector.

I know 2 people who were saved by these detectors as well.Bad furnace in the house is all you may need to kill you.

I've never heard it was law that smoke detectors were mandatory. What a crock!!!

So 30 people dieing a year is the mandate for government to step in. Out of the 20-30 million in California.

Not to be callus but just think how many other activities government will now figure they need to control if it involves a few deaths a year. Off-roading won't be far down the road.

Things are getting pretty ridiculous. They are forcing people to buy certain light bulbs, forcing restaurants to put calorie counts on their menus, forcing snack food companies to change their products, etc.

I had an argument with my friend over this. He thinks it's fine for the government to tell people that they're eating wrong because they don't know any better. It's truly sad when people believe that the government is smarter than the people and needs to make choices for them.

People don't just educate themselves you know.


Besides, it's cheaper to pass a law than it is to educate.

Gullans said installing such a device is prudent because she has small children.

But she’s concerned low-income families may not be able to afford the devices.

“It seems like something they should subsidize,” Gullans said.

Oh, now THAT'S a surprise. Something else the taxpayers are responsible for. Gotta love the "Hope-N-Change" crowd and their entire entitlement mentality. Have fun paying for this one too.

They truly will not be able to enforce anything till it's time to sell the home. Funny, we told DirecTV to get effed a while back and I don't subscribe to the local paper so this is the first I've seen of the new law. Are they going to send mail to EVERY Commifornia address informing the residents they are having more choices made for them? Seriously doubt it... Please don't get me wrong here, I don't think it's a bad idea to have one... but it should be a choice.

Ask your buddy about all the friggen medicine our gov "passes" off to us that ends up killing us..
Their oversight into our food and medicine is almost criminal....
It's like taking advice from a drug dealer.
Point being, better teach your buddy that history proves that the gov doesn't have OUR best interest in mind, never has..
A stamp of approval from the gov only tells me somebody got "paid"..

Good thing they tackled this worthy problem instead of the myriad of other lesser problems that plagues this state.

Now, every time I pay nearly TEN PERCENT in sales tax, another TEN PERCENT in income tax, pay taxes twice on used vehicles, $500+ vehicle registration bills, drive over potholes large enough to swallow small children on my street, devote another 5% of my income to property taxes, watch embezzlers get $500k+ "severance" packages and not get prosecuted, think about inmates that cost us $40k+ a year each, and other aneurism-inducing state lunacy, I'll be glad knowing my family is safe because the state made a law requiring me to install something I've had in my house since I bought it.

Question for all the personal rights people out there: does this mean the state has due cause to enter your home because they need to inspect your CO detector?

No. The max penalty for violation is "actual damages not to exceed $100" unless you've already been cited... then the penalty is $200 per violation. It's an infraction, not a misdemeanor, so I don't see the CO-detector SWAT team kicking in doors any time soon. That said, if you have an inspector in your home for other reasons (remodel, etc) I'd say they're able to write you up if they see it.

It's more geared to the resale market, it will now be part of the checklist for home inspections, like water-heater bracing and smoke-detector installation.

If you own rentals, you'll have to have this done ASAP.

FWIW, here's the specifics:

  • Any gas appliances such as a gas stove, gas furnace, gas fireplace, gas water heater, etc.

  • An attached garage (even if there are no gas appliances in the house!). Cars continue to emit CO even after they are shut off.
  • ANY rental dwelling that meets the criteria listed above. Yes this means that if you own a house, condo, or townhouse that you rent to another human being, you are REQUIRED to install Carbon Monoxide detectors.

As of January 1, 2013, ALL houses that meet the criteria listed above will be required to have Carbon Monoxide detectors. Even those that are not being sold will be required to have them just like smoke detectors. [emphasis added]
