what are yore experiences with slip and falls in a retail store?

being a manager in a store i deal with these often. but when the wife called me about a week ago at work and said she slipped on a grape and fell i was really concerned. she just called me from the dr office and turns out she might have tore her rotator cup.

a outside company is suppose to be handling this case but all they have done is called and asked how she is doing and that they are investigating this. according to the law it is half customer responsibility and half store unless the store is not doing hourly sweeps and checks of the store.

yes these are things people dont expect to happen to them when they go shopping.

everyone please be carefull when shopping. i have seen drains back up onto sales floors, stupid people throw food on the ground etc.

the last time i called 911 these 2 kids about 7 or 8 were climbing on the side of a basket and a 11 mo. old baby was strapped in and came down on its head onto the cement floor. it was not a good thing to deal with at all. the parents were claiming that the cart had a bad wheel. after the ambulance left i watched the video and saw the parents walk away from the cart and the kids climbed on the side.

They had a segment about this on 'What would You Do" or somesuch show the other night. Payday for some folks.

That sucks about your wife falling. There will be plenty of video showing just what happened, even if you have a little difficulty getting them to fess up with it. You will also know exactly when the last time they swept was too. I hope she feels better soon!

Reminds my of when my wife and I were in this grocery store in Kellogg, ID once when we were on vacation, and she got a shard of glass in her toe(someone had broken a jar of something earlier, and this shard was just missed, that's all) and like a lot of glass wounds, there was some good blood, but my handy dandy swiss army knife tweezers had the shard out and we had a band-aid on her toe and life was good. The store manager was there trying to get her to allow him to call an ambulance for her, they must have had a dozen box boys bringing up peroxide and bandages for her. they were scared shitless we were going to sue.

I sometimes wondered why we even carried them when I was with Albertsons, seemed like someone was slipping on those things all the time, they are like magnets i tell ya.

Is it half and half in your state, cause it wasn't like that here in Oklahoma. We paid on tons of claims for slip/trip and falls.

Having been on the other side before, I'd say you need to get pics of exactly where the incident happened (the store already has), the store won't give out a copy of the video surveillance so your out there, but I'd make sure they have it, and have it saved already because it can work in your favor.

I don't know how many times our produce guys would pencil whip that floor safety sweep sheet, I'd always look for even times on the sheet, like every 30 minutes on the dot, that's a dead giveaway they are cheating the system.

Make sure and write down exact time and date and any names of people she talked to. keep the reciept if she checked out. Tally up all the money you've spent in that store in the past, it shows your not a deadbeat looking for a payout, we tended to pay more easily with "regulars" than with people we hadn't seen before.

I'd call the store and ask the manager for the contact information, I know we were told once we turned in the report, we couldn't give any info out, once the claims office had it, we were done, but we got a nice report monthly with insurance costs on it, and alot of that kept us from being profitable many quarters.

also make sure the dr. office knows that it happened in a store, but I'm sure she already did that.

there seems to be nothing louder or more sickening than that sound, I've heard it many times, and wonder how can you people leave your kids standing, jumping, pulling, pushing, etc. the basket with no supervision.

that sound is still with me, and makes me cringe when i think about it.

I was about 20' away from a mom and a grandma in costco when they walked about 7' away from the baby in the cart, and the baby stood up, and just took a header off the side of the cart to the concrete. You are right, the most sickening sound I ever heard.

i see this everyday and for some reason when i warn the parents they just dont seem to care.

During the mid 80s I was checking out and put my hands down on the rail next to the conveyer belt.. A busted piece of the belt caught my hand and pulled into the metal piece it goes under.
Just about tore my fingers off my hand..
They called the ambulance and got me patched up and offered me all kinds of crazy deals in the way of free shopping.. I just pleaded with them all that they didnt tell my parents..
Boogied home and told my dad it was a sporting accident.

Still to this day, I dont think I could have ever sued them. Just not in my blood.

yeah they look at you like WTF mind your own business, but those are the first ones to throw up a lawsuit!

My family used to own two 7-11s. Guy wants to come in and my Dad asks him to wait a few minutes, he just mopped the doorway, Dad will get him what he came for. Guy says dont worry its fine. Gets his stuff, falls on the way out, tells Dad to call an ambulance he is hurt. Dumb ass sits there yapping with Dad and other people walking by. As soon as the ambulance drives up, he starts screaming bloody murder about his leg. So the ambulance guys scoop him up and take him to the ER. Cop that takes the report is buddies with my Dad- tells him this sucks, you will get sued. Dad takes him and shows him the film. Dumb ass did his act under three different camera angles.
No money, do not pass go.

When i worked for pavilions as my first job i would often do the sweeps cause it was easy and something to do when store was not busy.I had to sign the sheet that stated i did a sweep.Was more than hourly too at times.

One day i saw a blue trail that ended up as soap followed it around a few isles.did the cone thingy and mopped it up.

Turns out someone slipped on it i didnt find out til a few months after i last worked there i got deposition from an attorney vons sent an attorney with me for this as well(I was not being sued but vons was).They had alot of questions about sweeping and procedure and my bases were covered as well as stores but they still did settle with the plaintiff.

Several years ago, I slipped in a puddle of something, I assume water, buut not sure at a CVS store.
I had to have knee surgery.
After I recovered I contacted the claims dept of CVS and told them I was released. I had talked to them before, filed paperwork and was told to contact them upon release from the DR.
When I contacted them, they asked me what I wanted to settle this....
I told them my medical bills where $XX,XXX.00
The said teh could offer me $5000.00 to settle.
I explained that if I took teh $5K, I would be in dept to my insurance company for $XX,XXX.00 because I accepted a settlement. He agreed but said thats all he could offer.
I had no choice but contact an attorney.
the attorney got me approx 5x the medical cost without going to court.

I learned a lot from them...

my "video" disappeared from the store, with no explanation...
there were no sweep records...

Had I been in the produce section of the store,and slipped on a banana, I would have had a very weak case....one would expect produce COULD be on the ground in a produce section of a store.
IF they had a cone out that said "caution" or "wet floor" I would have had a very weak case...

Point is, there is some assumed risk depending on what department you are in, and what is known to be on the shelves. In other words, it would not be unusual for a banana to be on the ground in a produce section of a store...
you have to show that they were negligent. If they have sweep records that show they have been diligent in their floor cleaning, a piece of fruit on the floor will be very hard to show as negligence on their part.

I was very happy with my case and my attorneys. The sad part is,m had CVS just paid my medical bills, I would have settled out of court and they would have saved 10"s of thousands of dollars...
