Full Version: I come to the church for advice...

Not four months ago I took over payments on a friends quad. He was like a day away from getting it repoed. He was 3 months behind and scense I have cought it up and kept it current, while it has been in his name.

Now he says he wants it back and can afford the payments. Legaly I have the paperwork that it's mine as long as I am making payments on it. Moraly I feel bad that he has no ride. For crying out loud this is the guy that intoduced me to Glamis.

I'm really stuck on this one. When I didn't have anything to ride this guy had a new quad that he couldn't make payments on, but I could, so I helped him out. If I let him have it back I'll be rideless. The Boss (wife)says if I let him have it back I'll just have to save up and pay cash for a new ride. I got the Baja but it needs $500 worth of work before I can even take it on the street, and if I sold that I could never get enough out of it to get a decent ride, not to mention what I have put into it. And If I had the $$ to build it up enuff to keep up with quads I could just buy a quad.

Someone is ganna have to sit out a season or two and the balls in my court. What would you do? THANKS IN ADVANCE FOR ANY INSIGHT YOU MAY HAVE FOR ME IN THIS MATTER.

Well Jon, You have two choices...1st you can give him the bike back and keep a riding partner (as long as he can pay you back in full for any moneys you have invested in the bike and I would not give it back until then). 2nd, you can keep the bike and loose a friend. You have the canceled checks that show you have been paying for the bike, But do you have any paper work that showes he released any interest in it to you?

If the money you get back can fix your Baja then you both might be happy. This is why you don't buy or sale with a friend!!!!!!!!!

But first of all I took on the payments to help a friend. I thought I was taking on a multi year comemetment to get him out of a bind. He really doesn't seem to have any $$ to make up for the payments I have made, but he has been VERY HELPFUL with other things. I just posted my Baja on trader on line for an outragious amount. If I sell it every thing would be great. Mayby my friend could get my Baja going and I could give the quad back to him. ????

personally i think a good friend is more important than a bike.

As far as the money goes, maybe a payment plan or something like that, i would say just talk with him and work something out.

Yeah, you can't just let him have the bike back after you've made several hundred bucks in payment. He's got to pay you back for it, friendship or not. If you let him off the hook, he just might take advantage of you again. Payments are good or you can each split the payment and share the quad. Thats asking for trouble in my opinion though. If you can somehow get the money from him, you can put it down on a used bike and keep your payments the same. That way, you each have a bike and he doesn't owe you anything.

He has to pay you all the money you used to catch the payments up. The money you lost over the months affected your quality of life for you and your family. You had to tighten your belt couldn't he have done the same. Get the money in full that you have into it (did you buy matching gear etc) past payments all of it other wise he is not a true friend since you did him a great favor. Myself he would be charged interest on it.

Is he really acting like a friend? He made you a deal, you bailed him out of a repo on his credit and now that he is back on his feet he says to you "I want the bike back the deal is off"! If he valued the good times you both had together like you mentioned as much as you do he would not do this to you! It sounds like a decension on your part needs to be made and only you know whats best for you! Either way you will have a memory of this deal went bad every time you see him or that bike!

Of course, no one here can fully appreciate your prediciment because no one really has an understanding of your friendship with your friend. As Dune said... "Never borrow money from a friend."
That being said, if you were to return the bike to your friend then it would seem to me that that friend would be very GREATFUL for all that you did for him. One way for him to show that gratitude would be for him to let you use the bike any time you needed it. Also I think it is very important that he pay you back for the money you shelled out for him. HE should consider this extremely important and if it was me I wouldn't even consider asking my friend to return the bike until I had all the money owed to my friend to pay him back. You can always offer to let HIM use it any time he wants! <grin>

I learned the hard way to NEVER loan money, borrow money, become partners with...unless you know and trust that person unconditionally, and everything you two agree to is in writing to avoid any confusion.
Did he sell it to you or did you just loan him the money? Friend or not, business is business. He needs to reimburse you for payments that you made before you return the bike, or you need to buy him out. If he still has title, you have no legal claim to the bike...he just owes you money. This is when you find out what kind of a friend he really is. Your first obligation is to you and your family, and your wife has made her feelings clear concerning your ability to get a "toy". Good luck with this. I have been there!!

THANKS TO ALL WHO HAVE GIVEN ADVICE SO FAR! I had a talk with my friend today. I told him I plan on keeping the quad and getting it into my name as soon as possible. Right now its a good thing to keep it in his name as we are looking to buy a house and any debt is a negitive. So we need to make up something in writing to show the intentions of both parties. We agreed on this part.

As far as one of us being without a ride. We will work together to get my Baja going and held together for the season. He is great with mecanical things and I call on him for help with most all repairs. He said he wanted a baja not too long ago, so I am letting him use and store the Baja at his house so he can use it/see what it's like to own one. Like I said earlier the Baja is in bad shape but I have seen this guy keep a rail together thru 4 seasons and sell it for more than he bought it for. The Rail was on it's last leg when he bought it so I trust him. Another positive thing is because of my stroke a year and a half ago I haven't had that much use of my left foot and found it hard to use the clutch, so if anything I get a choufer=) I'm kind of excited about that because in the rail he use to own we were like a team. he was crazy enough to drive and I was crazy enough to ride with him while having a good scense of direction to get us where were going.

I also told him if he was ever allowed out of the house and wanted to take the quad out he could.

IMPORTANT AGREEMENT: "he breaks my quad he fixes it"! The Baja is MINE but he is the "crew cheif"/"Driver" If the Baja breaks it would probably break if I were driving so I'll take care of the parts, he takes care of the installation. Or atlest helps.

Seems like a win win for me. In theory of course.

This should be interesting...

Thanks all again, feel free to point out flaws in the new plan if you wish. I'd be interested in the insight.

its cool you came to an agreement. a friend and myself are partners in a motorhome that we are fixing up to use for glamis, and we have a kawai tecate 3 in the deal too. we agreed from the start thats on these two things its 50/50 all the way. and if one wants out, we take monthly payments for a then determined amount(since we got these two toys for under a thousand bucks we will probably base the buyout price on the money invested to get them running). we also let our freinds ride our other bikes and we have one rule if you ride our stuff, you break it you pay to fix it, or we horsetrade for it. we never lend each other major cash though, that never works out.

I just got off the phone with my friend. We were talking about what we need to do before our yearly T-day trip. The subject came up, that we should of started on the Baja a long time ago. Well hell it's been hot and I don't have a place to work on it around my place. He does. That got me thinking...Not only can duners hang at the dunes but they can hang during the off season work'n on their toys. Sounds like a good plan you got going with your friend Kevin.

If I could afford a warehouse with an acre or two of land around it I'd invite everybody to bring their shiznit for a wrench'n party. user posted image

The thing about the wharehouse with a few acres sounds like what my dads got goin on.

We've got 4 jeeps, a rail, some bikes, golf carts all sitting in this huge house that used to actually be a house but is now stripped out. I go there to work on the jeeps and him and his friends all get to working on the stuff they got in there...

It works out great for me because I am young and need their expertise! Then, they forget about their projects and start working on mine heh heh- is that being manipulative?

We as a group should rent some warehouse you can drive into. Store all our toys and work on them there. We would need one good compressor for the all of us to use and thats about it. You use your own tools. I would think a lot of people pay for storage of their toys all over.

How much would a huge place be? Probably in the Inland Empire would be cheaper.

Just an idea that will probably never happen.

a few freinds of mine actually went and got a 2000sf shop to work on their drag cars and stuff. for me right now my garage is the shop for the bikes since i have all the tools. but it would be nice to have room to move around in there.

How about a nice big A.C.ed wharehouse near Glamis. Test area would be close. Price would be cheaper. A close storage place to where we ride. BUT there is A lot of problems like if we wanted to go to say Gorman, El Mirage, Pismo, we'd have to drive down and get our toys and drag em back up.

Then there is coming up with the cash and do thoes with the most toys stored pays more than a guy who just has a quad there?

Ya too many variables to rent somewhere. I too am cramped in my garage. Small trailer with my buggy on it, the van, motorcycle and all the tools and camping junk. I know somebody who rents a space at the Brawley impound yard for 20 a month. Never been there with him but sounds like a good deal if you have an enclosed trailer.

My business partner and one of our friends who introduced us to the dunes went in on a rail together (The yellow front engine 350 I've posted shots of) and it damn near destroyed their friendship. They finally worked it out this month when my partner gave our friend a jetski to buy out his portion of the rail. Thankfully they both ended up happy with the deal.

A year or so ago the three of us were talking about renting a shop we heard about here in Yuma. Three garage shop with a swamp cooler for the shop area and a separate A/C'd office section off the side. Would have only run us about $150 a month each but it never went through - the guy who owned it decided not to rent.

Last week however I think I may have found my own solution. A friend is getting rid of the old shed in his backyard - 10'x13' with a 6'2" door. My rail fits inside it perfectaly. And my landlord said no problem putting it in my backyard - it's mine just for taking it out of the guys yard. Woo Hoo A separate rail garage - now I've just got to wait for him to get his new shed!

Jon, the movie u are thinking of is called "Cheech & Chong's Next Movie" the third movie in the installment(starting with Up In Smoke). I love that movie!! I never laughed so hard in my life as when Chong fired up that bike and then jammed on the guitar!! I was literally on the floor!!

What was your first clue I didn't have a woman in the house...the bike...the bottle rocket on the table...the beer brewing on the kitchen table (Wrapped in the white towel)...the empties ..or just the general trash laying around?

Ladies, just so you know my bike now lives in the garage instead of the living room. The brewery has been relocated to a friends house. I finally figured out what day is trash day. I now have real curtians instead of a bed sheet. Oh, but I do still tend to have bottle rockets and the like laying around I am still a bachelor after all user posted image
