Ok, real quick....
I finally got cited for not paying my parking fee. I had thrown my receipt away since I was done with it and they refused to let me leave the park without paying again. Finally, they had to call a BLM Ranger to cite me. Took over a half hour. Oh joy, what fun. So, now I get to take it to court, explain to the judge why collecting on the way out is illegal and hopefully get that road block removed!
Why is collecting the Demo Fee on the way out of the ISDRA illegal, you ask? I'll tell ya why.
In this great country of ours in order for a law enforcment officer to make an arrest, a citation is an arrest, he must witness the offense himself. He cannot rely on suposition or guesswork, there must be real proof that an infraction has occured. For instance, you cannot get a ticket in your vehicle for speeding based on someone telling a cop that you were speeding. The cop must see you speed.
In the case of the parking permit they have absolutely no idea what I was doing in the ISDRA. They SUPPOSE that I was there, riding my threewheeler because I have one in my trunk but they did not witness me parked at Glamis. The Demo Fee law specificly says that you must pay to park. It does not say you must pay to leave.
It's my contention that if the BLM was forced to collect the fees correctly, that is, on the way in... then the cost of collecting would be more than the amount collected and would be breaking the original law that was inacted by congress. Then the entire Demo Fee could be removed from Glamis.
Anyway, I got a citation for not paying to park while "leaving" the ISDRA. Go figure.
