This stems from my "New trailer gets smashed into" thread.
Lets say it happens to you, something damages your trailer and your are skeptical if they will pay for it. You decide to keep his ATV or buggy as collateral until they pay.
1. Is this legal
2. Would it be considered stolen if they reported it as stolen even though they know who has it.

I don't believe it is legal and it would be considered stolen. But possession is 9/10ths of the law

Plus you might end up in a fight if they don't want to do it.

That's "you" deciding you are going keep "his" ATV. That's like me deciding I am going to keep your truck. It isn't yours so I don't think you can decide to keep it.
Did you file a police report and everything? With a police report, you should be able to get the guy to pay you.

I fled a report when I got home since the guy (sheriff I think/rent a cop) was told via radio "we don't take reports".
The local CHP office told me they'd forwasrd it to Imperial.
I asked what if he doesn;t pay and they said it's a civil matter.
Guess they'd only care if I shot him.

That's amazing. I obviously don't know the story of what happened. But if it happened in Glamis at the fault of someone else then whatever LEO was available should've taken the report.

if it is a non injury accident a lot of times law enforcement will not take a report. as far as taking his stuff until he pays that is theft and if the value is greater than $400 then it is grand theft a felony. the police are right when they say it is a civil matter. you need to take his a$$ to court and get your money. probably not what you wanted to hear but this is the law

Oh well, will give it some more time then take more action.
what information do you have of the person that caused the damage to your trailer? just curious. i wouldve taken down all the info on his drivers license including his driver licenses # and made sure it was current.

you're the in the clear. did anyone else besides yourself (in and not in your group) hear him admit to guilt? Do you have any pictures of his bike and the damage? pictures of him? anything like that?
Where is Vicki. I'm sure she knows this front and back.

Unless the owner (who matches the proof of title) sets it up with you in advance, you have no legal right to retain his property. And even then, you'd better have the pink slip (you would basically be a lien holder) in your possession or, no matter what he says to you, he could always claim theft.
However... once you get a judgment againt him for the damages (and believe me, you will

), you can offer to take the bike to pay off his debt to you.
I knew this guy raised my neck hairs.

I had someone's kid racer hit my trailer in camp once. Dented the aluminum and tore up the steps pretty bad. Gotta get it welded.
Then someone else's kid let go of my side door in a windstorm and it put a pretty good ding in the aluminum.
Then a tire blew and tore up the plastic fender on one side.
I've had two different people ride my quad and roll it. Put some pretty good creases in the plastic. To date, no one has ever paid for any of that damage.
I know you might not want to hear this, but sometimes stuff happens and you just end up sucking it up and chalking it all up to an expensive hobby.
I know it doesn't seem right, but when 80% of the damage to my stuff is from other people or out of my control and I end up paying for it, that's about the bottom line. JMHO.

SoCal, it's different when it's inside your camp.
But when it's from a camp quite a distance away, strangers, that's a whole different story.

I too have had similar experiences. While they're standing in front of you scared shiatless, they will say anything. Once they're gone and home, it's a different matter. I hope your case turns out differnet, good luck.

One time a lady went over the curb at my Mom's house and took out an expensive shrub, probably a $300 or $400. It matched others, so you really couldn't start over with a young plant.
She was well dressed and drove a very nice car. She apologized profusely and told my Mom she'd pay for everything, just call her and tell her how much, and she'd send a check, mail her the receipt.
She came into my Mom's house, sat and had coffee and dessert with her, chatted for about an hour, I think they even swapped recipes. The lady left her name, phone #, address, DL #, Lic plate #.
ALL of it was fake. There were the corect # of digits, and the numbers were probably kinda close, but none of it was correct.
Some people. What can ya do?

Mike...sorry to hear that it isn't working ou so far. Since you have his D/L info, you can attach a lien through the courts to collect.
I had a similar incident couple of years ago:
Out breaking in the new Raptor (yeah, I had an effin brain fart), cam back and saw this large tent all balled up, metal frame and all, on the side of my shiny Tundra. Pulled tent away and saw dents, scratches and a crack in the rear slider. Pissed I was!!
5 minuutes later this couple and their friends show up to claim tent. exchanged all the info, and went home. It took a while, they didn't pay right away, and then my insurance company (USAA) let me know that since they were Allstate, it could be filed against their home-owners' policy. Called 'em up and said, here it comes..they paid and made sure their insurance company took care of me.

thats why you take down the info, aparently the car was outside, unless it was stolen, you have somthing to go off of. i can go right now and finf out who the registered owner of a car is, where they live and Misc. other things. license plates are great.

My truck got dented last year at the SSSS. Bruce from Tatum clipped it with his trailer. I went and got an estimate to get it fixed, and sent it to him. Had a check the next day. And it cleared. Some people in the world still have honor.
I haven't had time to get it fixed yet but the money is in the bank for when I can go ten days without my truck.

Had a cat in camp riding a 50, he was on Gecko and lost control in some sand and hit a truck. The owner of the truck was mad and grabbed the 50 and put it in his trailer. This cat told him he would pay and it wasn't his 50 and gave him his ID and asked for the 50 back and he told him to f off. The owner of the 50 went down and asked for it back and had his reg. with him, guy told him to f off. And the "truck" owner called to cops, they came and arrested HIM for theft? Kinda weird. The truck owner wasn't to nice to the cops or the cat or the 50 owner.

Similar thing happened to a guy in our camp. He was going down Olds when some guy took off solo blasting up the hill right at the pack of cycles my buddy was in heading down. Put a huge dent in the side of his spankin' new pipe, tore up his bars and brake lever, bent his peg and gave him a couple good raspberries.
They limped the bikes down the hill and exchanged information. I told him we oughta follow the guy back to his camp (he was with 3 friends, we were with about
