Might need to contact the BLM on that one. There was only a couple of signs, no enforcement, and people still rode there just as much as before. There is an ATV rental that does business there, I'll call them and let you know what they say Michele. Gregg

I called the BLM office down the street from Windy Point, they have not called back yet. The off rental next to windy point said that windy point is still closed.

I am the Field Manager for the Bureau of Land Management in Palm Springs. Windy Point will remain closed under an interim closure until BLM's plan amendment is completed. At that time the final plan amendment decision will be implemented.

When will the plan ammendment be completed and what's going on with the fringe toed lizard? Any studies that show the little beastie isn't endangered?

I don't have any new information on the little beastie but maybe I can translate into English what the field manager was trying to say.

The Windy Point closure is just one of the many that were included in the settlement demands of the Sierra Club/PEER/CBD lawsuit. So the temporary closures will remain in place until a final management plan is adopted, which hasn't been done yet (remember, the BLM decided to break down the great big California Desert Plan into many little ALLEGEDLY easier to manage plans).

Daniel Peterson was on local TV here in the Palm Springs area a few weeks ago, he was protesting a new development north of I-10 here. He was talking about fringed toed lizard this and tortise that...no one seemd to take much notice around here to him, he looked to be alone.

Wasn't a presentation made on this management plan at the Desert Hot Springs DAC meeting? I believe it was. Windy Point was one of 3 areas for OHV use that they were considering a total of about 1300 acres. While they were CLOSEING over 1 MILLION acres permanently. Currently there is no legal OHV areas in the Coachella Valley. I commented at that meeting that they should midigate and open all 3 proposed OHV areas totaling just over 3000 acres (if my memory serves). 3000 for 1,000,000 is not midigation it's Un-American.

Its my understanding that Peter Griffiths is not the person to write even thou his name is on the page of the Draft. I am going to try and find out who is the person to direct all the letters too. Here is what he had written back to me:

Dear Ms. Zumstein,

Thanks for taking the time to write to me. I understand your concerns - and
even sympathize with them. But I think you misunderstand the nature of the
report we have written.

As you may know, the Coachella Valley Fringe-toed lizard survives only in
unique places within the valley: active sand dunes where sand of a
particular size is available. Active sand dunes are constantly changing:
sand is always blowing away, but fresh sand is always arriving from
somewhere else. Right now, this type of lizard habitat is protected in two
ecological reserves in the northern Coachella Valley: at the Whitewater
Reserve (along the river south of the railroad tracks and east of Indian
Avenue) and at Willow Hole (north of I-10 and east of Mountain View Road).
We were asked by the US Fish and Wildlife Service simply to find out where
the sand comes from, how it gets to the dunes, and to estimate how much
sand is still arriving there. As scientists, we simply investigate and
report on the natural geologic processes. We have no authority for making
public land-use policy and do not do so in our report.

In addition, our study area is well to the east of Windy Point. I am not
familiar with the area in which you ride, but I believe it was not the
subject of our report.

I mention these points not to discourage you, but to make sure you direct
your concerns to the those who make the decisions you are clearly
passionate about. I suggest you contact the Coachella Valley Association of
Governments or the US Fish and Wildlife Service.
