I will try and make a long story short....Any information would help!

I traded my Tundra in on 9/8/05 and got all my approval/loan letters mid month. I kept checking with Toyota to see if they have recieved payment with no luck. I have perfect credit with them and this would have been my third car paid off. I got a call today from Toyota saying they have reported my delinquent credit to the bureau. They reviewed the notes that I have been back and forth with them all month about pay off and they said to get the ck # and all that from Mazda.

I called Mazda and they said they just sent the payment overnight DHL YESTERDAY....over a month after I traded in my truck!!!! Never have I had a car dealer wait that long! I told them Toyota already reported me and to have the delinquency removed I had to get a letter from Mazda saying I did indeed trade it in on the 8th and that its not my fault. They refused!!! They even had the nerve to say that I will be getting a bill in the mail for the difference! They said that when I bought the new car the bal due on the toyota was one amount and by the time they paid it off it was higher and I owed them the difference. I told them NO cause it wasn't my fault they waited so long. And when I bought the car I had a letter from Toyota saying the payoff and how long it was good for.....PLENTY of time for them to pay it off. They accepted the letter at the time and said no problem it would be paid off before then.

This is just one small problem that I have had with Mazda since I bought this car...don't get me wrong I love my new car just hate the company!

Since I have been going back and forth with the companys I have been having really bad cramping and pressure and I don't need the stress in my life for my baby's sake!

My question is....do I have a lagit gripe here and if I were to take this to a lawyer would I have a chance? This isn't worth my time but I had such a good standing with toyota that I don't need this small thing to ruin my credit that I have working so hard to maintain!

p.s. another thing on the sticker of the car it said fuel economy was 21 city 27 highway and I have only gotten 19 mpg ALL HIGHWAY miles.

You have paper work that shows you traded the truck in right?? And you should have a bill of sale showing the truck was used as a trade in. All that should be dated. Send copys to both partys and hope for the best.

Toyota isn't the problem they have been helping me out as much as they can and giving me tips to deal with mazda.

Mazda is the problem they said they show all paperwork and payoff info and acceptance letters and signed agreement but they said this is policy to go after the lost money. They don't care what paperwork is involved.

I can call you later, I have a doctors appt right now. Send me your # sista. icon_biggrin.gif I can say this. Per Fair Credit Reporting Act, Toyota is required to report you @ 30/60/90 days past due. No matter when you traded in your car. The contract on the truck is between you and TFS. Now, Mazda is just being a jerk off when sending the $$$. I have dealt with this many times from non toyota dealers. They "float" your money as long as possible before having to send in a payoff. I would ask for the tracking # from DHL (business office at the dealer should be able to provide this to you) and where they sent it. If they say the PO box in city of industry, they are blowing smoke because no overnight deliveries are accepted there. They should have sent it to Chandler AZ. As far as extra $$ accured for interest, the dealer should have called for a current payoff. If they didn't or refuse to pay it, contact the GENERAL MANAGER ( don't eff around with anyone else there) and explain the issue, how much is still owed etc. TFS will date the payoff the date it is recvd in the office, not the posting date. And next time someone calls you from TFS, ask to speak to a supervisor to get this straightened out. Or call them ahead of time w/the DHL # and ask them to please PLEASE waive the 30 day past due mark due to the situation. AS LONG AS YOUR ACCOUNT IS OPEN a sup has the authority to do a one time waiver of the mark. Once the account closes, it is a real pain in the ass because you MUST dispute w/ all 3 bureaus. I already gave Toyota the tracking #, Ck # and amount and they have been really good about it. I don't have ANYTHING negative to say about them. They have been great with all three vehicles I have owned through them! The only question I did have about toyota is since they already reported it to the agency can they still waive the 30 day past due?

If I remember right, when I've traded in any of my cars...don't you sign a release of liability or something that states you are no longer financially responsible for the car?

Wright a letter to Mazda ASAP to: Director of west cost operations, explain in detail the situation, and that you are trying to purchase a home, that this situation is causing you a financial hardship, and losses (key wording) and you will seek compensation under the "Fair Credit Reporting Act”,

Urge them to corrected situation immediately in order to minimize your losses and the amount of claim you will be submitting to them

QG couldn't have said it better. I repair credit for a living. Submit the paper work to a "MANAGER" no one else. 30 day lates are easy to remove, expecially when you have the paper work.

You need to file a complaint with DMV an investigator will look into it and they will make sure the dealership fixes any wrong doing.

As long as your account was still open, Toyota can request the 30 days removed. Once it closes though, you will need to take it up with the bureaus temselves. Toyota also has a dept in Iowa that you can dispute the 30 day mark with you on a closed account. Toyota also keeps your accts that you have ever had with them on the computer for the past 15 years or so. Now the reason why that is important is they will be more likely to remove a 30 day mark if you have had more than one account, and if they have all been in pretty good standing. icon_biggrin.gif

Now when you trade in the car you do sign the Release of Liability. HOWEVER that does NOT release you from you financial obligation to TFS or any lender for that matter. It is just a DMV form that protects you in case of an accident, speeding ticket, registration renewal fees etc from the date that you trade the car in. I always recommend people continue the payments until they know it is paid off. That way if there is an overpayment, TFS will refund the extra directly to you, not the dealer that paid it off. And you protect your credit too. I know that you shouldn't have to do this stuff, but it helps you in the long run. TFS will also send you a letter with the phone #'s and addresses of all 3 bureaus. MAKE SURE TO DISPUTE IN WRITING WITH ALL 3! Also you can dispute w/TFS in writing to the above mentioned dept. If you would still like me to call you, I'd be happy to.
