AZ Car Accident Advice.

My wife just got hit by a person running a red light. They have already been cited based on the evidence at the scene and witnesses. Most important thing is my wife is “ok”. But as you would expect experiencing some neck and back pain. Went to ER already. The car is pretty banged up 2015 Altima. Question is should we seek a lawyer? I’ve never gone through this kind of stuff before.

Yes get a attorney and it more to cover your butt.

YES!!!!!!  Get a attorney and expect a pay out in one year to a year and a half.   Seriously  keep a diary of every day pain scale from 0 to 10 and what is hurting.  Get a more popular big-name attorney.  And remember nothing can be done $$ until after the pain is 100% gone away.    P.S.  if she needs therapy for any neck or back pain or any other pain, make sure she gets the therapy sooner than later.  Attorneys do this kind of work every single day of their lives. I can pretty much guarantee you don’t even know 5% of what to do and attorney will 100% know what he can and will do.... Best of luck and I hope your wife is not too hurt. Thanks RK. I figured this would be a a long process but from what I’ve heard it’s a good idea to seek a lawyer, especially when it’s the other parties fault.

because the insurance company will drag this shit out till forever and will drag their asses through the mud to not have to pay out. Been there done that!

Just do not say ANYTHING about this period to the others insurance company, nothing. They will call and ask how your wife's feeling and seems like genuine concern, they are fishing, be careful.

Was sitting at a light one night and a drunk plowed into the back of my car.  Me and my buddy were both Ok but my neck started to tighten up and he ha a cut on his little finger.

Truck was drivable so after the cops arrested the drunk in a rental car we left and I decided to go to the ER , because my neck was tightening up. Mty buddy who had no ride from the ER and had good insurance decided to get checked out also.

I was told nothing broken or out of place was going to be sore for a few days.  They pulled a tiny piece of glass out of his little finger.

My neck tightened up a lot and I got a Lawyer.  Lawyer sent me to a Doctor the Doctor saw me 3 times a week for 2 months.

My friend didn't do anything

After I was released from the Doctor the Lawyer called and said they were willing to pay out 15K, Doctor bill was $5K , Lawyer took 1/3rd  so he got $5K leaving me with $5K in my hand about 2 months after I was released.

Just after I picked up my check from the Lawyer my buddy stops by wants to thank me for convincing him to go to the ER that night he wanted to show me the check he got for $7K from the insurance company.  They contacted him he told them he was Ok and just had that cut and the ER cleared him and he had no lasting injury or pain from the accident. They asked for a copy of the bill from the ER that his insurance covered  he was out his $50 co-pay and that was it.

He never asked for a penny and got $7K .

 Neck/back pain can come on years later and last for years. Dont mess around with it, get treatment. I had a wreck 10 years ago and still get terrible nerve pain and swelling a few times a year

 Neither insurance company will take care of you or defend you like they are your mom or dad. The attorney will represent you 100% as a mom or dad would .......lol.

Hate to break the news to you but that attorney doesn't give a shit about anything other than getting paid. He does nothing more than have a secretary type a letter to the Insurance carrier and takes a good chunk of your settlement. Complete waste of your money.

I've been thinking about getting Pre-Paid Legal (basically a low monthly fee) to protect myself from stuff like this and possibly save paying lawyers a big chuck of money.   Does anyone have any good or bad comments about Pre-Paid Legal?

  I have no idea why you dislike attorneys but in my circle of family and friends it’s unfortunate we were all put in bad circumstances but the attorneys have helped each one of us numerous times  to fight for our rights 100% where there is absolutely no one else that will do that. Especially both insurance companies only care about themselves.....

Insurance is just like everything else in life now...all the information will get punched into a computer....how much was the car damage...what did the Dr say about injuries...They don't pay all the treatments just because you get an Atty....who gets 30-40% and Files a Lien with both carriers..just in case you drop them....The insurance company is going to value the claim and pay that amount regardless of Atty involvement or not.   If you are Seriously injured....you will get payment.

What are the other drivers limits?  Was it a new car? Old Car?  What are your limits?  Do you have uninsured coverage?  Do you have medical payments?  Do you have private insurance...they will try to recover if its the result of a collision....

Talk to  your insurance carrier and see what they say...if they piss you off get an attorney.  They are actually easier to deal with then customers, because they understand what is going to get paid and what isn't.

If it does go to court...expect to deal with this for the next couple of years....

I hope everyone recovers and is not seriously injured.

I never said I dislike them. I said they don't care about you. I had over 20 years handling Auto claims so I'm speaking from 1st hand experience. We could care less if the client had an attorney and it certainly didn't make us offer any more money. When it comes time to settle you are throwing away 25-50% of your settlement for someone who did nothing more than send a representation letter to the adjuster in most cases. 

I hate to see people lose that money. I recommend dealing direct with the Insurance first. As a consumer you are protected by the Department of Insurance and the Insurance Company must follow the guidelines set forth in their state. There is a provision called the Unfair Claims Settlement Practice Act. Read up on that before hiring an attorney.

 Funny you make it black-and-white but there’s many many shades of gray you just passed up. Insurance companies will not protect your rights anywhere near a attorney well. It is unfortunate I’ve been in a few accidents and even the insurance companies that I have had stated you should seek legal counsel against the other guys insurance company.  Even the insurance companies tell me to seek legal counsel, what does that tell you?  It is not the insurance companies position or job to protect my interests beyond their scope. This was Farmers Insurance and Allstate insurance that told me to seek an attorney.

That is a big reason to rely on a lawyer, because from my dealings with insurance companies they would probably shoot that down if it occurred after time had elapsed.  The injury specialist lawyers most likely know how to handle that situation.

It sounds like they were protecting your rights by advising you to seek counsel. The Insurance companies are governed by the Fair Claims guidelines in CA. Bad faith dealing is a big deal and gets people fired. The CA Department of Insurance is a huge advocate for consumers in CA and pretty much governs everything that goes on in an insurance claim. If the insurance people worked for a  horrible company, they  wouldn't have said anything to you about seeking counsel.  Not all insurance people are bad, and yes some companies go out of the way to screw people, just like lawyers do.

I was rear-ended in 2005, A-Hole drove under my truck. Totaled my truck which pushed me into the car in front of me which I demolished, I had a nice ride in an ambulance,  The EMT told me to stop moving my arm to which I said I wasn't moving it. He grabs my arm and it was in a full spasm. My shoulder hurt like crazy from the seat belt. I knew something wasn't right.

I'm with State Farm and they are awesome, but I did get a lawyer as well. Messed up shoulder and 2 years of chiropractor, cortisone shots then finally surgery to remove part of my shoulder blade.

Lawyer handled everything and yes he took his cut, but my surgery was paid for which was $20k and I ended up with about 8k in my pocket. I still owed on my truck but I had Gap insurance. So I walked away from that.

John Upton was the lawyer from Newport Beach. He and his team were great to work with.
